1. Personal information / personal data policy
The first time you buy an item on Foodgear.dk, you are registered as a customer. The personal information we register is: name, address, telephone number and e-mail. We register your personal data with the aim of being able to deliver the goods to you. When we collect personal data via Foodgear.dk, we ensure that it always takes place with your express consent. You must be informed about exactly what information we collect and why. No other personally sensitive information is recorded. Information is passed on to a third party (Google) with the aim of improving the experience at foodgear.dk. The data controller for Foodgear.dk is director Therese Fischer.
As registered with foodgear.dk, you always have the right to object to the registration. You also have the right to insight into what information is registered about you. You have these rights according to the Personal Data Act and inquiries in connection with this should be addressed to: butik@foodgear.dk.
When you visit Foodgear.dk, advertising cookies will be placed on your computer so that we can understand what you are interested in. Our advertising partner, AdRoll, helps us present you with retargeting advertisements on other sites based on your previous visits at Foodgear.dk. Our partners do not collect personal information such as your name, email address, postal address or telephone number. You can visit this page (http://www.networkadvertising.org/choices/) to opt-out of AdRoll and its partners' targeted advertising.
2. Ordering goods
Goods can be purchased at Foodgear.dk. Entrepreneurs can also contact us by e-mail. At the end of the product order, you will automatically receive an e-mail receipt/confirmation of the order, which states which products you have ordered. We recommend that you save your confirmation and any print it out.
3. Prices
All prices on Foodgear.dk are stated in Danish kroner (DKK) and include 25% VAT, customs and payment card fees. Shipping takes place through GLS Danmark and any costs will appear before you complete your order.
4. Terms of payment
Payment for ordered goods can be made online using Dankort, MasterCard and VISA. When you order an item, we reserve the money on your card, and it will only be withdrawn when the item is dispatched. There is no card fee when paying by card at Foodgear.dk.
5. Conclusion of agreement
With each purchase, you must accept the terms of the trading conditions. You are encouraged to read the terms thoroughly and familiarize yourself with the obligations and rights that the terms give you. You will receive a copy of the terms when you receive a confirmation of your order per e-mail.
6. Change of order
When changing the purchase after placing the order, you can change the order by writing an e-mail to Foodgear.dk. Customer service will help you change your order, but ONLY if the item(s) have not been shipped. If the goods have already been dispatched, you have a 14-day right of return.
7. Warranty, transfer of risk and complaints
The Purchase Act's defect rules may apply to goods purchases. Unless better terms are listed next to the individual item, we grant a 24-month right of complaint on all items in accordance with the Sales Act. The right to complain means that you can complain about errors and defects that appear up to 24 months after you received the item. The right to complain expires if the defect is caused by the buyer, for example as a result of faulty or unauthorized repair or use. It is also a prerequisite that the defect was present when you received the item for the first time. You must advertise within a reasonable time after you have ascertained the defect. If you complain within 2 months, the complaint is always considered to be timely.
When you want to complain about a product, you must write an e-mail to Foodgear.dk When we receive your complaint, we will send you an e-mail with your return order number and the address to which you must send the product. You must write the return order number on the parcel's shipping packaging, as this makes the handling time faster. You can demand that we remedy the defect or deliver a new defect-free item if the prerequisites for exchange are present.
This assumes that the complaint is justified and that the remedy or redelivery does not entail disproportionate costs for us. Once we have become familiar with your complaint, we will contact you by e-mail to agree the further process. If the complaint is justified, we will refund your (reasonable) shipping costs. The item must always be sent back in proper packaging, and remember to get a receipt for sending so that we can refund your shipping costs.
8. Right of withdrawal
As a consumer, you have a 14-day right of withdrawal when you shop with us. The withdrawal period expires 14 days after the day you receive your item, or receive the last item in physical possession, in the case of an agreement for several different items, which is ordered in one order and which is delivered individually.
You must notify us within 14 days of receipt that you wish to cancel your purchase. The notification must be given at butik@foodgear.dk or by using the standard cancellation form. In your message, you must make us clearly aware that you wish to exercise your right of withdrawal. You cannot undo it by simply refusing to receive the item without clearly notifying us of this at the same time.
You must send your order back to us without undue delay, and no later than 14 days after you have notified us that you wish to cancel your purchase. You must bear the direct costs in connection with the return shipment of the goods. You bear the risk for the goods from the time of delivery of the goods.
When returning, the product is thus re-placed in the manufacturer's sales packaging and securely packed in the correct shipping packaging. You may not stick labels or write directly on the manufacturer's sales packaging. This must be done on the shipping packaging.
Missing original packaging may constitute a reduction in value, so to be sure of receiving all the money back, it is recommended that the item is returned in original packaging.
You are only liable for any deterioration in the value of the goods which is due to handling other than what is necessary to determine the nature, characteristics and way of functioning of the goods. In other words, you can try the product in the same way as if you tried it in a physical store, but you must not take it into actual use.
If the item has been tried on in addition to what is described above, we consider it as used, which means that if you cancel the purchase, you will only get a part or none of the purchase amount back, depending on the item's commercial value.
If you regret your purchase, you will get the amount you paid us back. In the event of a decrease in value for which you are liable, this will be deducted from the purchase amount.
If you exercise your right of withdrawal, we will refund all payments received from you, including delivery costs (but not additional costs resulting from your own choice of a different form of delivery than the cheapest form of standard delivery that we offer), without undue delay and under all circumstances no later than 14 days from the date on which we received notification of your decision to withdraw from this agreement. We will make such a refund using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise.
We can withhold the refund until we have received the item back, unless you have provided documentation that you have returned it before then.

9. Shipping and delivery
As a starting point, Foodgear.dk sends the goods no later than the business day after the goods have been ordered. The delivery time is approx. 1-3 days. You will of course be contacted by e-mail or phone if we cannot live up to the above. Our deliveries are made in collaboration with recognized carriers and service partners. Delivery costs are calculated depending on the number of items, their weight and size. You will always be informed of the total delivery costs when ordering goods before you approve your order.
10. Receipt of goods
When you receive your goods, remember to check for any visible damage. If the packaging is damaged or shows other visible signs of defect, you must sign for the waybill - subject to any damage to the contents. You can also refuse to receive the item. As a starting point, you should never sign for an item that you believe does not meet the order. Contact Foodgear.dk and state that you have rejected the item. If the packaging is intact, but you still find the item damaged or defective after unpacking, you must report it to Foodgear.dk. For evidentiary reasons, you should contact us by e-mail immediately after receipt.
11. Freight / delivery costs
The shipping prices are incl. transport insurance in Denmark.

14. Business customers – B2B (Business to Business)
There is no right of return unless otherwise agreed in writing. Foodgear.dk reserves the right for typographical errors, price errors, VAT and tax changes, sold out / discontinued items and delivery failures from our suppliers.
